According to a response to a FOIA request filed by the Transactional Records Access Clearinghouse (TRAC) at Syracuse University in a December 2022 letter, ICE was unable to locate records of 378,000 illegal immigrants taken into custody and placed in a federal program to “ensure non-detained non-citizen compliance with release conditions, court hearings, and final orders of removal”. The response to the FOIA request said:

“ICE has conducted a search of the ICE Enforcement and Removal Operations (ERO) for records responsive to your request and no records responsive to your request were found”

It is not uncommon for political agencies to respond to FOIA requests with a response indicating a failure to find records, even if they do exist and the agency knows where they exist.
